1. Acceptance of Terms
These Terms of Service ("Terms") are a legal agreement between you and Marluna Studio LLC ("LandlordHQ," "we," "us," or "our"), the operator of LandlordHQ. By creating an account or using LandlordHQ, you agree to be bound by these Terms. If you do not agree, do not use LandlordHQ.
2. Description of Service
LandlordHQ is a property management application that helps independent landlords track units, tenants, rent payments, maintenance requests, documents, and expenses, on the web and on iPhone. Features and pricing may change as we improve the service.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and promptly update it if it changes. You are responsible for the accuracy of the tenant, unit, and lease data you enter, and for having the legal right to enter and process that data.
4. Subscription & Billing
LandlordHQ offers a free plan for a single unit and a paid Pro plan billed per unit, per month. Paid plans automatically renew at the end of each billing period (monthly or annually, depending on your selection) until cancelled. Payments are processed securely by Stripe; by upgrading, you authorize us, through Stripe, to charge your payment method on a recurring basis for the applicable fees.
You may cancel at any time through the billing portal in your account settings. Cancellation takes effect at the end of the current billing period; we do not provide prorated refunds for partial periods except where required by law. Fees may change with advance notice; continued use after a price change takes effect constitutes acceptance of the new price.
5. Acceptable Use
You agree not to use LandlordHQ to violate any law, infringe on any third party's rights, store or transmit unlawful content, attempt to gain unauthorized access to our systems, or interfere with the service's normal operation. We may suspend accounts that we reasonably believe violate this section.
6. Disclaimer & Limitation of Liability
LandlordHQ is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not guarantee the service will be uninterrupted or error-free. To the maximum extent permitted by law, Marluna Studio LLC will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or business arising from your use of LandlordHQ. Our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months preceding the claim.
7. Termination
You may stop using LandlordHQ and cancel your paid plan at any time through the billing portal. We may suspend or terminate your account if you violate these Terms, fail to pay applicable fees, or if we discontinue the service, with notice where practicable. Once your account ends, your right to use LandlordHQ stops; we will retain or delete your data consistent with our Privacy Policy.
8. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the app before the changes take effect. Continued use of LandlordHQ after changes take effect constitutes acceptance of the updated Terms.
9. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles, and any disputes will be resolved in the state or federal courts located in Delaware.
